And I believe you may download a copyrighted game if you have bought or own the game for backup purposes. If they gained enough proof that you have done something illegal, they could probably sue you for damages, but it would probably cost them more than they would gain.

This offspring is illegitimate because you used illegitimate pokemon to get it. It will be either legal or illegal based on whether the parents were legal or illegal. If you go to a tournament, legality is the ONLY thing that matters. Just don't tell anyone you have illegitimate pokemon or you will be disqualified. Some people don't like illegimate pokemon because they like to work for them. Some people don't like making legitimate pokemon because it can potentially take hours or days if trying to breed for Hidden Power.

Regardless of legitimacy, however, you can only play online or in a tournament if the pokemon is legal. Your pokemon is illegitimate. Does it matter? Do you care? That's your opinion.
